The Supreme Court on Monday again struck out an application filed by the presidential candidate of the Hope Democratic Party (HDP), Ambrose Owuru, challenging the re-election of President Muhammadu Buhari.
The four-member panel led by Justice Olukayode Ariwoola struck out the appeal following a dramatic withdrawal of an application for the appeal to be heard again. Counsel for HDP, Sunday Ezema had requested the court to reverse itself in the judgment delivered on October 3 and restore their appeal.
During the court hearing on Monday, the court drew the attention of Ezema, to Section 285 (7) of the 1999 Constitution which provided that the court has 60 days from the judgement day to hear and determine the appeal and was asked whether the appeal had not become statute-barred.
Mr. Ezema insisted the appeal can still be heard, but however, made a u-turn and applied for withdrawal of the application. Meanwhile, Justice Olukayode Ariwoola passed his judgement and struck out the application.
