The Kano state High Court has granted Emir Muhammad Sanusi II, the Emir of Kano, leave to file a motion seeking Judicial review of the preliminary report issued by the Kano State Public Complaints and Anti-Corruption Commission (PCACC) demanding for his suspension pending an investigation into the allegation of financial misappropriation levelled against him.
The presiding Judge, Justice S.B Na-Mallam said because the case was transferred from a different court, it has to start afresh, saying one of the ex-parte application filed by the Emir earlier on January 21, 2020, translates to abuse of court process as it was a duplication of the one filled last year June 6, 2019.
Justice Na-Mallam revealed he has disregarded the second application because he had already accepted the first one.
He disclosed, by this ruling, the Emir has satisfied the requirement of seeking leave and was granted to him and that has made his case okay for next hearing at the adjoined date.
Meanwhile, the court has restrained the PCACC from proceeding with its investigations against the emir pending when the substantive matter would have been heard.
The case has been adjoined to March 10, 2020, for the hearing motion of notice.
In a similar manner, the case filed by Alhaji Munir Sanusi (Danburam) and four others, seeking the court to declare PCAACC not qualified to investigate the Emir, so that they could not proceed as one of the defendants in the matter that was not ready.
The case was adjoined to April 8, 2020, to continuation.
