The Court of Appeal sitting in Ibadan, the capital of Oyo state yesterday struck out the judgement awarded in favour of the Yoruba-Nation agitator, Sunday Adeyemo better known as Sunday Igboho, by the High court. Recall High court sitting in Ibadan had sometimes last year awarded damage against the Department of States Services, DSS, for allegedly invading the residence of Sunday Igboho for his possible arrest in July 2021. The presiding Judge, Justice Ladiran Akintola in his ruling declared that the raid carried out by the DSS was unlawful and therefore directed the secret police to pay damages to the agitator for attempting to arrest him.
Igboho has approached the court praying that the agency should pay him N500billion damages for invading his house to arrest him.
The Judge described the action of the secret police as “arbitrary aggression and prejudices” over the agitator's claim of demanding the Yoruba nation.
However, in an appeal filed by the Director of DSS, the Attorney General of the Federation and the Oyo state government, the Appeal Court upheld that the High Court judgement delivered in September 2021 was acted on the wrong side of the law by awarding damages to the agitator and therefore set aside the judgement.
Sunday Igboho has been in detention in the Benin Republic after he was arrested by the Benin authority when he sneaked out of Nigeria en route to Europe.
