The Supreme Court has today declared that Executive Order 10 (EO10) signed by President Buhari on Judicial and Legislative autonomy is illegal, unlawful, and unconstitutional. During the seven-man panel sitting of today at the apex court, a split decision of six to one was issued declaring the Executive order assigned by Buhari to have overreached his constitutional powers in issuing the order.
Six out of the seven Judges that sat on the matter declared the order as unlawful as only one of the judges delivered a descending judgment.
The lead judgment prepared by Justice Musa Dattijo and was read by Justice Centus Nweze, insisted that the responsibility of funding state courts lies with the state government not otherwise.
Sometimes last year, the 36 state Governors filed an originating summons before the supreme court following the order signed in May 2020 by president Buhari, arguing that section 121(30 and 6 of the 1999 constitution as amended states that state governments are only to maintain a recurrent expenditure of the lower courts of the states while the Federal Government would take care of the capital projects of High courts upwards as superior courts of records.
