Kenya's Chief Prosecutor, Keriako Tobiko has ordered the police and anti-corruption agency to investigate the country's election commission for alleged "irregularities and illegalities" in the annulled presidential poll Al Jazeera says. Tobiko said the investigation of the officials of Independent Electoral and Boundaries Commission (IEBC) must be completed within 21 days to allow relevant government agencies take necessary actions against those that would be indicted.
He explained that speedy conclusion of the investigation would assist IEBC in excluding officials prone to compromise from the conducts of the fresh poll.
Following the annulment of the earlier election by Kenya's Supreme Court, the IEBC has been ordered to conduct fresh poll within 90 days. The poll is billed to take place on October 26 with opposition party threatening to boycott the exercise if the government attempts to rig it.
Tobiko's letter requesting the investigation read in part “thorough, comprehensive and expeditious investigations into the irregularities and illegalities found by the SCOK (Supreme Court of Kenya) to have been committed by the IEBC in relation to the Presidential Election with a view to establishing whether electoral and/or other criminal offences (including corruption and economic crimes) may have been committed by the IEBC officials or any of them and those who may have aided, abetted, counselled or procured commission of any such offence(s).”
He also said the authorities should investigate allegations made by the National Super Alliance against 11 senior IEBC Commissioners and allegations from Kenyatta's Jubilee Party that two senior NASA leaders illegally accessed IEBC records.
Recall that SCOK annulled the election on August 8 after Uhuru Kenyatta was declared winner. Raila Odinga had petitioned IEBC claiming that the election was rigged in favour of the incumbent.
