Court of Appeal Sacks Senator Abbo

The Court of Appeal in Abuja has sacked Senator Elisha Abbo of the All Progressives Congress (APC) representing Adamawa North district. The judgment which was delivered on Monday by a three-member panel led by Justice C.E. Nwosu-Iheme, declared Amos Yohanna, the candidate of the Peoples Democratic Party (PDP), as the rightful winner of the election.


The Court then ordered the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Yohanna.

Yohanna filed a petition at the Tribunal sitting in Yola, challenging the victory of Senator Abbo but the Tribunal dismissed Yohanna’s petition, citing lack of merit.

The PDP candidate through his lawyer then approached the Appeal Court, after hearing arguments from both parties, the Court declared that based on Section 137 of the Electoral Act, 2022, the tendered results indicated that there was no compliance with Electoral Act.

The Court, deducted the invalid votes from both parties and discovered that PDP’s Yohanna won the Senatorial election by a majority of lawful votes.
