The Supreme Court has nullified the election of governor David Lyon of the All Progressives Congress, APC and his Deputy, Biobarakuma Degi-Eremieoyo, on Thursday, Feb. 13, following the appeal made by the Peoples Democratic Party, PDP, its governorship and deputy governorship candidates in Bayelsa state, Douye Diri and Lawrence Ewhruojakpo. A five-man panel of Justices spearheaded by Justice Mary Odili unanimously held that Degi-Eremieoyo presented a forged certificate to the Independent National Electoral Commission, INEC.

The court explained that since the duo shared a joint ticket Deji-Eremieoyo's invalidation invariably affects their nomination by the APC. INEC has been ordered to immediately withdraw the Certificate of Return issued to Lyon, and issue a fresh one to the party that secured the second-highest number of votes and got the required constitutional spread.

Justice Ejembi Eko, who delivered the lead judgement reinstated November 12, 2019, Judgement of the Federal High Court in Abuja, that disqualified Degi-Eremieoyo from participating in the governorship election.
