Bayelsa gov’ship Election: Supreme Court Affirms Lyon’s Nomination

The Supreme Court has today upheld the primary election of the All Progressive Congress (APC) that produced David Lyon as its candidate in the party.

 

A five-member Justices lead by Justice Mary Odili has today quashed the appeal filed by one of the APC candidate, Heineken Lokpobiri, challenging the nomination of David Lyon as the flag bearer of the APC during their primary election.

Mr Lyon won the Bayelsa state governorship election setting history in the state for the first time opposition won an election.

Justice John Inyang Okoro in a lead judgement declared that the appeal has become statute barred citing the section 285(9) of the 1999 constitution as the appellant approached the court in 14 days after the time frame for litigation become stale.

The panel collectively posited that the cause of action which arouse after the primary election that was held on September 4th, 2019 lapsed on September 17, 2019.
